Terms and Conditions

These Terms and Conditions (“Terms”) govern all bookings and services provided by Cape Town Tandem Paragliding (“CTTP”, “we”, “us”, “our”). By making a booking, paying a deposit, or participating in any activity offered by CTTP, you (“the client”, “you”, “your”) confirm that you have read, understood, and agreed to be bound by these Terms.

If you are booking on behalf of another person or a group, you confirm that you have the authority to accept these Terms on their behalf, and that you have brought these Terms to their attention.

1. Definitions

  • Activity means any tandem paragliding instructional flight, lesson, course, or related service offered by CTTP.
  • Pilot means a tandem flight instructor operating under CTTP, licensed in accordance with the South African Hang Gliding and Paragliding Association (SAHPA) and the South African Civil Aviation Authority (SACAA).
  • Booking means a confirmed reservation for an Activity, secured by payment of a deposit.
  • Indemnity means the written indemnity and assumption-of-risk document required to be signed prior to participation.

2. Our Services

CTTP offers instructional tandem paragliding flights and related services from launch sites in and around Cape Town, including but not limited to Signal Hill and Lion’s Head. All flights are conducted by qualified tandem flight instructors in accordance with SAHPA and SACAA regulations.

3. Bookings and Payment

  • A deposit of R350 per person is required to secure your Booking. The deposit forms part of the total payment for your Activity.
  • The balance of the fee is to be paid at any time before, and no later than immediately after, the completion of the Activity.
  • We accept cash, EFT, and credit card payments. All credit card payments incur a 3% handling fee to cover processing costs.
  • Prices are subject to change without prior notice. The price applicable to your Booking is the price quoted at the time your Booking is confirmed and your deposit is received.

4. Eligibility and Health

By booking an Activity, you confirm that:

  • You are physically and medically fit to participate in a tandem paragliding flight.
  • You have disclosed to CTTP, in advance, any medical conditions, injuries, pregnancies, or other circumstances that may affect your ability to participate safely.
  • You meet any weight, age, or other participation requirements communicated to you at the time of booking.

The following participation requirements apply to all tandem flights:

  • Weight: minimum 20 kg, maximum 120 kg.
  • Age: minimum 14 years. Clients under the age of 18 must have the Indemnity signed by a parent or legal guardian (see clause 5).

CTTP reserves the right to refuse participation, without refund, where a client does not meet these requirements or where the Pilot determines that participation would be unsafe.

5. Indemnity and Assumption of Risk

Paragliding is an inherently risky activity. All clients participate at their own risk.

Prior to any Activity, every client is required to read, complete, and sign CTTP’s standard Indemnity form. The Indemnity will be made available at the launch site, and may also be sent in advance.

Clients under the age of 18 are required to have the Indemnity signed by a parent or legal guardian. CTTP reserves the right to refuse participation to any minor without a properly signed Indemnity.

Failure or refusal to sign the Indemnity will be treated as a cancellation by the client and the cancellation terms in clause 7 will apply.

6. Conduct and Safety

  • Clients must follow all instructions given by their Pilot before, during, and after the Activity. The Pilot’s decisions on safety matters are final.
  • No alcohol consumption is permitted before or during the Activity. Clients who arrive intoxicated, or who appear to be under the influence of alcohol or any other substance, will not be permitted to fly. No refund will be issued in such cases.
  • CTTP reserves the right to refuse or terminate participation, without refund, where a client’s behaviour is deemed unsafe, abusive, or disruptive.

7. Cancellations, Rescheduling, and Refunds

Due to the weather-dependent nature of paragliding, flight times may vary. Bookings may be delayed, postponed, or rescheduled at the sole discretion of CTTP, its owners, and management.

A summary of our cancellation terms:

  • Cancellations more than 24 hours before the Activity: eligible for a refund or rescheduling, subject to availability.
  • Cancellations within 24 hours of the Activity, or “no-shows”: a 100% cancellation fee applies. No refund will be issued.
  • Weather cancellations by CTTP where rescheduling is not possible: a refund may be issued, subject to a 10% administration fee.

8. Personal Property

The owners and management of Cape Town Tandem Paragliding cannot be held responsible for any loss of, or damage to, any property of the client, including but not limited to phones, cameras, sunglasses, jewellery, clothing, and bags. Clients bring personal items along on the Activity at their own risk.

9. Limitation of Liability

To the maximum extent permitted by law, and without limiting the Indemnity:

  • CTTP, its owners, employees, contractors, and pilots shall not be liable for any indirect, incidental, consequential, or special damages arising out of or in connection with any Activity.
  • CTTP’s total liability in respect of any Activity shall not exceed the amount paid by the client for that Activity.
  • Nothing in these Terms purports to exclude or limit any liability that cannot be excluded or limited under applicable law, including the Consumer Protection Act, 2008.

10. Photos, Videos, and Media

Photos and videos of your flight are available as an optional add-on and are charged separately from the flight fee. Pricing for media is provided at the time of booking or on request.

The supply of media is a direct transaction between the client and the Pilot. CTTP may facilitate payment for media on behalf of the Pilot, but CTTP accepts no responsibility for the media itself, including but not limited to its quality, content, delivery, storage, or any technical failure affecting the capture, recording, or recovery of photos or video.

In the event of a technical failure that prevents the delivery of purchased media, the client will be refunded the amount paid for media. For the avoidance of doubt, a technical failure or other issue relating to media does not entitle the client to a re-flight, additional flight, or any other form of compensation beyond the refund of the media fee.

Where media is successfully captured, the digital files will be made available to you after the flight. CTTP may use photos and video footage of clients for marketing, social media, and promotional purposes. If you do not wish for your image to be used in this way, please notify your Pilot or CTTP staff before your flight.

11. Force Majeure

CTTP shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from circumstances beyond its reasonable control, including but not limited to adverse weather, fire, flood, load shedding, civil unrest, strike action, regulatory changes, airspace restrictions, pandemic, or acts of God.

12. Privacy

CTTP processes personal information in accordance with the Protection of Personal Information Act, 2013 (POPIA). Details of how we collect, use, store, and protect your personal information are set out in our Privacy Policy.

13. Changes to These Terms

CTTP may update these Terms from time to time. The version of the Terms in effect at the time of your Booking will apply to that Booking. The latest version will always be available on our website.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of South Africa. Any dispute arising out of or in connection with these Terms shall be subject to the jurisdiction of the South African courts.
