These Terms and Conditions (“Terms”) govern all bookings and services provided by Cape Town Tandem Paragliding (“CTTP”, “we”, “us”, “our”). By making a booking, paying a deposit, or participating in any activity offered by CTTP, you (“the client”, “you”, “your”) confirm that you have read, understood, and agreed to be bound by these Terms.
If you are booking on behalf of another person or a group, you confirm that you have the authority to accept these Terms on their behalf, and that you have brought these Terms to their attention.
CTTP offers instructional tandem paragliding flights and related services from launch sites in and around Cape Town, including but not limited to Signal Hill and Lion’s Head. All flights are conducted by qualified tandem flight instructors in accordance with SAHPA and SACAA regulations.
By booking an Activity, you confirm that:

CTTP reserves the right to refuse participation, without refund, where a client does not meet these requirements or where the Pilot determines that participation would be unsafe.
Paragliding is an inherently risky activity. All clients participate at their own risk.
Prior to any Activity, every client is required to read, complete, and sign CTTP’s standard Indemnity form. The Indemnity will be made available at the launch site, and may also be sent in advance.
Clients under the age of 18 are required to have the Indemnity signed by a parent or legal guardian. CTTP reserves the right to refuse participation to any minor without a properly signed Indemnity.
Failure or refusal to sign the Indemnity will be treated as a cancellation by the client and the cancellation terms in clause 7 will apply.
Due to the weather-dependent nature of paragliding, flight times may vary. Bookings may be delayed, postponed, or rescheduled at the sole discretion of CTTP, its owners, and management.

The owners and management of Cape Town Tandem Paragliding cannot be held responsible for any loss of, or damage to, any property of the client, including but not limited to phones, cameras, sunglasses, jewellery, clothing, and bags. Clients bring personal items along on the Activity at their own risk.
To the maximum extent permitted by law, and without limiting the Indemnity:
Photos and videos of your flight are available as an optional add-on and are charged separately from the flight fee. Pricing for media is provided at the time of booking or on request.
The supply of media is a direct transaction between the client and the Pilot. CTTP may facilitate payment for media on behalf of the Pilot, but CTTP accepts no responsibility for the media itself, including but not limited to its quality, content, delivery, storage, or any technical failure affecting the capture, recording, or recovery of photos or video.
In the event of a technical failure that prevents the delivery of purchased media, the client will be refunded the amount paid for media. For the avoidance of doubt, a technical failure or other issue relating to media does not entitle the client to a re-flight, additional flight, or any other form of compensation beyond the refund of the media fee.
Where media is successfully captured, the digital files will be made available to you after the flight. CTTP may use photos and video footage of clients for marketing, social media, and promotional purposes. If you do not wish for your image to be used in this way, please notify your Pilot or CTTP staff before your flight.
CTTP shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from circumstances beyond its reasonable control, including but not limited to adverse weather, fire, flood, load shedding, civil unrest, strike action, regulatory changes, airspace restrictions, pandemic, or acts of God.
CTTP processes personal information in accordance with the Protection of Personal Information Act, 2013 (POPIA). Details of how we collect, use, store, and protect your personal information are set out in our Privacy Policy.
CTTP may update these Terms from time to time. The version of the Terms in effect at the time of your Booking will apply to that Booking. The latest version will always be available on our website.
These Terms are governed by the laws of the Republic of South Africa. Any dispute arising out of or in connection with these Terms shall be subject to the jurisdiction of the South African courts.
